Data Residency
Where Should Your AI Agent’s Data Be Stored? UK, US, UAE and India Explained
Short answer: for most businesses in the UK, the US, the UAE and India, the law does not require customer data to be stored inside the country. It requires that data sent abroad is protected, through adequacy decisions, contracts or similar safeguards. Local storage becomes a hard requirement in particular sectors, such as payments in India or health data in the UAE, and through some contracts. So the right question to ask a vendor is not only "where is it stored?" but "where is it stored, where is it processed, and under what safeguards?"
This is a general guide, not legal advice. Rules change; confirm with your adviser.
What does each market require?
| Market | Main law | General local-storage rule? | Transfers abroad | Where local storage can be required |
|---|---|---|---|---|
| United Kingdom | UK GDPR and the Data Protection Act 2018 | No | Allowed to countries with UK adequacy regulations, or with safeguards such as the International Data Transfer Agreement or the UK Addendum to the EU clauses | Some public-sector and client contracts |
| United States | No single federal privacy law; sector laws and state privacy laws such as California's | No | Generally allowed; obligations come from sector rules, state laws and contracts | Some government work and sector contracts |
| UAE | Federal Decree-Law No. 45 of 2021; the DIFC and ADGM free zones have their own laws | No general rule | Allowed to countries with adequate protection, or with appropriate contractual safeguards in limited cases | Health data, under its own federal law, and some regulated sectors |
| India | Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025 | No general rule | Allowed except to countries the government restricts by notification; most obligations from 13 May 2027 | Sector rules, such as the Reserve Bank's payment data storage rules |
What is the difference between storing and processing?
Storage is where data rests: the database, files and recordings. Processing is everything done to it, including the moment a voice call is turned into text and a reply is written. An AI agent almost always uses specialised services for speech and language, and those can run in other countries even when storage does not. A vendor that only answers "stored in the UK" has answered half the question.
Which data does an AI agent handle?
- Conversation history across calls, WhatsApp, chat and other channels.
- Call transcripts, outcomes and, if switched on, recordings.
- Contact lists you upload for campaigns, and your do-not-contact list.
- Your knowledge base, which may include price lists and policies.
- The details of actions the agent takes in your systems, such as a booking.
Map each of these before you decide what to put into the agent. If your agent looks records up live in your own database through an API, those records can stay in your database, but the conversation itself still passes through the vendor.
When does local storage really matter?
- Regulated sectors. Payments in India, health data in the UAE, and some financial and public-sector work everywhere.
- Your contracts. A client contract may require data in a specific country, whatever the law says.
- Customer trust. Some buyers simply prefer data near home. That is a sales question, not a legal one, but it is real.
If none of these apply, a vendor storing data in a country with strong protection, with clear safeguards for processing elsewhere, is usually a sound choice.
What should you ask a vendor?
- In which country is my data stored at rest, including backups and recordings?
- Which parts of a call or chat are processed in other countries, and which countries?
- Under which safeguards are those transfers made?
- Is my workspace separated from other customers' data, and how?
- Are recordings optional, and how long are they kept?
- Are the credentials I connect, such as my phone provider and store keys, stored encrypted?
- How do I ask for data to be deleted, and who handles it?
- Do you store payment card details?
How ThinnestAI answers
Your region is chosen when you sign up. Workspaces for the US, UK, UAE and the rest of the world are stored in the United Kingdom (London); India workspaces are stored in India (Mumbai). On international workspaces, speech recognition runs in the EU and the voice and the language model run in the US, under UK transfer safeguards. We do not store data in the US or the UAE today. Recording is a per-agent switch, off by default; connected credentials are stored encrypted; and we do not store card details. The full answer is in where your data is stored and our privacy policy.
Whatever vendor you use, you remain responsible for telling your own customers how you use their data under the law that applies to you.
